CONDITIONS OF PARTICIPATION
for "cashback with hashtag"
Prize draw for 12 months after purchase on www.powerbude.eu from January 2023
If designations relating to natural persons are only given in the masculine form in these conditions of participation, these refer equally to women and men.
1st item
1.1. The organizer of the competition is "Stefan Strohmayr, CDC, Friedhofstrasse 19/3, 2351 Wiener Neudorf (hereinafter referred to as "Organizer").
1.2. By participating in the competition, participants accept these conditions of participation.
2. Participation
2.1. Eligible to participate are natural persons (consumers within the meaning of the Consumer Protection Act; "KSchG") who are resident within the EU and are 18 years of age or older at the time of entering the competition.
2.2. Participation in the competition is only possible via the meta platform using hashtags and markings; Meta is not affiliated with this competition. Participation is voluntary.
2.3. The prerequisite for participation in the competition is the purchase of at least one power station with/without accessories via the website www.powerbude.eu and an invoice that is not older than 12 months. Participation in the competition requires a hashtag (#powerbude-cashback) and a page tag on meta (@powerbude.eu). Completion of participation in the competition requires uploading an invoice proving the purchase of at least one power station and accepting the conditions of participation and the data protection declaration of the organizer. This takes place after a successful draw and contact via the contact form on the website www.powerbude.eu. The raffle is successful if a valid invoice is uploaded within 10 days of being contacted by a Powerbude representative. All information must be truthful and complete.
2.4. Participation via lottery agencies (lottery registration services and third parties who commercially arrange participation in lotteries and/or prize draws) is excluded. The use of automatic participation software and manipulation of the competition is not permitted. Employees of the organizer and affiliated companies as well as their relatives and employees of cooperation partners who are or were commissioned to create and/or process the competition and their relatives are excluded from participation. "Relatives" also include those people who have the same place of residence and therefore share the postal address. Persons who have not yet reached the age of 18 at the time of participation in the competition (sending the entry form) are also excluded.
2.5. The organizer reserves the right to exclude people from the competition without giving reasons, in particular if this is necessary for reasons of fairness and equal opportunities compared to other participants.
2.6. The organizer also reserves the right to change or supplement these conditions of participation at any time without giving reasons, insofar as this is necessary in the interest of simple and secure processing and in particular to prevent misuse or for other reasons.
3. Execution and processing of the sweepstakes, winning packages
3.1. In the period from January 1st, 202x, 00:00 CET to December 31st, 202x, 24:00 CET (also referred to as the "participation period"), the Austrian website of the organizer (available at: www.powerbude.eu ) a total of 12 "winners" (also called "cashback for hashtag") were drawn (cashback for hashtag" also called "prize").
3.2. The profit is a maximum of 20% at 100% of the gross amount. If the power stations were purchased through discount campaigns (i.e. cheaper than the sales price), the difference will be offset. (e.g.: 5% discount campaign - 15% cashback for hashtag)
3.3. During the Entry Period, 1 winner will be announced at the end of each month (also called "Monthly Raffle"). The closing date for participation in the monthly raffles is the last day of the month, 24:00 CET (also referred to as the "monthly closing date"). Entries received after the monthly entry deadline can no longer be considered in the respective monthly draw. Participation is only possible in the following month (max. 12 months after conclusion of purchase, date of invoice).
3.4. All participants in a monthly raffle end up in a common raffle pot, from which the winners are randomly drawn by an impartial body (software) after the monthly participation deadline. The draw will take place in camera.
3.5. Each person may participate in the "Cashback for Hashtag" competition for 12 months. The prize will be paid out to the winners a maximum of 1x, except for a new invoice/purchase. The multiple use of a receipt is excluded. Each participant can only win one "Cashback for Hashtag" during the entire participation period. The monthly prize can only be won once, whereby there is no entitlement to receive a certain sum (i.e. it is solely up to the organizer whether a payout takes place in the event of a win). Prize is not transferable or exchangeable. There is no legal entitlement to a prize. The winners are not entitled to a change or addition to the respective prize; the prize will be triggered on the respective payment method used for the original purchase. The winners can forego the prize.
3.6. The winners of a monthly raffle will be informed in writing via the Fecabook profile no later than three weeks after the monthly participation deadline. If the account used is incorrect or invalid, the organizer is not obliged to find out the correct contact details. The disadvantages resulting from the provision of an invalid account, an incorrect e-mail address or other contact details are at the expense of the participant.
3.7. Winners of a "Cashback for Hashtag" must inform the organizer by e-mail to the e-mail address given in the prize notification within 10 weekdays whether they will accept the prize. If a winner refuses, for whatever reason, or does not contact the organizer within 10 weekdays regarding acceptance, the date expires. The prize will then be offered to another randomly selected winner, again using the procedure outlined above.
3.8. Winners will have their winnings refunded to the original payment method. The prize will only be sent to participants in the EU. The organizer is released from all obligations when the prize is handed over. In the event of an error (invalid means of payment, account details, etc.) there is no entitlement to a repeated sending of a prize. In the event that the contact details given in the entry form (in particular the specified return transfer option) of the participant are incorrect or outdated or the prize cannot be sent due to other circumstances for which the organizer is not responsible, there are no claims against the organizer; in particular, no prize will be sent again.
3.9. The winnings will be paid out as a credit and only in relation to a valid invoice (12 months after the purchase).
3.10. The Promoter reserves the right to adjust, change or cancel the competition if the need arises.
4. Liability
4.1. The organizer assumes no liability for any technical difficulties that affect the final result of the competition or participation in the competition. The competition can be terminated or removed due to external circumstances and constraints without the participants having any claims against the organizer. This applies in particular, but not exclusively, to cases in which the proper execution of the competition is made more difficult, influenced or impossible for technical or legal reasons.
4.2. The following exclusions and limitations of liability apply to any liability of the organizer, notwithstanding the other statutory provisions:
4.2.1. The organizer is only liable for direct damage caused intentionally or through gross negligence. Any further liability is excluded, unless personal injury is involved. The organizer is not liable for indirect damage, lost profits, missed savings, consequential and pecuniary damage, damage from claims by third parties or any other (indirect) consequential damage. Liability under the Product Liability Act remains unaffected.
4.2.2. These limitations of liability also apply to the personal liability of employees, representatives and vicarious agents of the organiser.
5. Miscellaneous
5.1. The organizer asks the winners to be careful with electricity storage.
5.2. The competition is in no way sponsored, endorsed or organized by Meta (formerly Facebook and/or Instagram) and is in no way connected to Meta.
5.3. About the lottery - unless otherwise regulated in these conditions of participation
– no correspondence will be conducted.
5.4. Any consequential costs incurred as a result of the respective prize must be borne by the winners themselves. Any taxes and duties in connection with the competition are also borne exclusively by the winner.
5.5. Legal recourse is excluded to the extent permitted by law.
5.6. Austrian law applies exclusively to the competition, to the exclusion of conflict of law rules. If legal recourse cannot be ruled out, the place of jurisdiction is the factually competent court in Wiener Neustadt, unless the legal provisions (for consumers in particular Section 14 KSchG) require a different place of jurisdiction.
5.7. Should individual provisions of these Conditions of Participation be and/or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.
